YOGA 40 PLUS (hereinafter Yoga 40 Plus) offers services in the field of health consultancy and yoga in individual and group formats. These are online courses, workshops, trainings, yoga holidays/retreats, community events, etc.
These Terms and Conditions (hereinafter T&C) govern the legal relationship between Yoga 40 Plus, the readers and users of the website or social networks and the participants of the courses and retreats.
The T&C’s are applicable to the purchase of any participant services obtained by any means (by phone, email, internet, mobile, on-site, etc.), in group or individual classes, from Yoga 40 Plus.
These T&C also apply in full to courses abroad or yoga holidays/retreats outside Switzerland.
These T&C are available in different language versions. In the event of contradictions, only the German language version shall apply.
By visiting the website or using the free or paid services of Yoga 40 Plus, these T&C are fully accepted by the participant and become an integral part of the legal relationship between the participant and Yoga 40 Plus. This creates a contract between Yoga 40 Plus and the participant.
At the end of a paid period, the contract will automatically terminate. The participant may terminate the contract by deleting his/her account or by terminating the business relationship, subject to any notice periods for yoga retreats.
For its part, Yoga 40 Plus reserves the right to terminate the contract at any time without stating reasons by blocking or deleting the user’s account or terminating the business relationship if this is deemed appropriate, in particular in the event of unlawful or improper conduct or if false information is provided. Yoga 40 Plus is also entitled to discontinue or modify a service or the entire offer at any time without compensation.
Psychological or physical limitations, as well as an existing pregnancy, high blood pressure, severe endometriosis or past breast cancer must be reported to the course instructor at the latest at the beginning of the course. Should a health restriction or pregnancy, high blood pressure, severe endometriosis or breast cancer occur during the course, the course leader must be informed immediately.
Each participant takes part in the courses on his/her own responsibility, so that it is also at the discretion of the respective participant to seek medical advice before taking part in the courses.
The health realted information accessible on the yoga40plus.com website is in no way a substitute for advice from a competent professional such as a doctor.
Yoga 40 Plus assumes liability for the proper execution of the courses within the framework of the legal warranty provisions. Any liability beyond this, in particular in the form of compensation for damages, is expressly excluded.
Users can create an account as a private individual on https://yogaundhormone.mymemberspot.de/. The user undertakes to provide the data required for registration truthfully and to keep it up to date. The use of the user’s personal details is governed by the data protection regulations.
Users may read content on the website or social networks, subscribe to the newsletter, receive free services or content, purchase products or paid services.
When a user posts a review, he/she implicitly authorises Yoga 40 Plus to use the provided content, photos and videos on the website or for promotional purposes.
The scope of each service (content, modality of classes, duration) as well as the corresponding costs are described on the sales page of each service on yoga40plus.com.
Yoga 40 Plus endeavours to describe the service as accurately as possible.
The courses do not take place on general public holidays and bridge days valid in Switzerland, Canton Thurgau.
Yoga 40 Plus reserves the right to cancel yoga classes – even at short notice – in the event of illness or unforeseeable circumstances, or to have a suitably qualified person substitute. Participants will be informed as soon as possible by e-mail or telephone of any cancellation with the exception of unforeseeable cancellations. In the event of a course cancellation, subscriptions may be extended accordingly.
Should an error occur on the sales page, Yoga 40 Plus reserves the right to refuse or cancel any order.
The price for each service is stated on the sales page for that service.
Payments can be made by bank transfer, Paypal or credit card and can be staggered as agreed in writing between the client and Yoga 40 Plus.
Payment is due in advance, prior to the start of the course, class or retreat.
Monthly yoga subscriptions expire after their effective date, are personal and non-transferable. Monthly yoga subscriptions are valid from the date of purchase.
Course fees paid for subscriptions are non-refundable. Monthly subscriptions can be paused for the advertised duration due to holidays or absences for professional reasons lasting longer than two (2) weeks at a time, if this absence is communicated in writing in advance. Subsequent breaks are not possible. In the event of illness, accident or pregnancy, the duration of all subscriptions can be paused accordingly on presentation of a doctor’s certificate.
There is no entitlement to a refund.
All pages on yoga40plus.com enjoy copyright protection. Imitations of any kind constitute an infringement of copyright and will be prosecuted and are liable to damages.
Yoga 40 Plus may amend these T&C at any time. The amended T&C will apply from their publication on the yoga40plus.com website. Registered users will be notified of the change by e-mail or other appropriate means.
Should any provision of these T&C be or become invalid or void, this shall not affect the validity of the remaining provisions.
These T&C are subject to Swiss law.
The exclusive place of jurisdiction for all disputes arising out of or in connection with these T&C and the legal relationships falling under them is the Canton of Thurgau, Switzerland.
Any dispute, difference or claim arising out of or in connection with the contractual relationship with Yoga 40 Plus (including the validity, invalidity, possible breach or termination of the contract or these T&C) shall be submitted to mediation in accordance with the Swiss Rules of Mediation of the Swiss Chambers’ Arbitration Institution in force at the time the request for mediation is submitted. Unless otherwise agreed, each party shall bear half of the costs of the preceding mediation proceedings. The seat of the mediation shall be Thurgau and the mediation shall be conducted in the German language.
